Impact of the Biodiversity Provisional Measure on Biotechnology Patenting in Brazil
Abstract
This paper aims at investigating the impact of the Brazilian provisional measure 2.186-16 and
other regulations on the invention activity in biotechnology through patent indicators analysis. The
research method used Bibliometrics as information analysis technique and the analyzed sample
comprised 478,709 bibliographic data of patent documents filed worldwide and indexed by Derwent Innovations Index database between 2001 and 2015. The developed set of indicators consisted the number of patent per year of indexing, per priority year and country. Furthermore, the known patent data filed in Brazil was extrapolated using logistic curves for evaluating the effect of changes in the legal regulations and procedures. We concluded that the intervention by legislation changes affected significantly the patent activity of biotechnological products and process, reaching a scenario of instability in the Brazilian system of legal protection in this topic.
