ETHNOBOTANY AS A TOOL FOR IDENTIFICATION OF GEOGRAPHICAL INDICATIONS AND COLLECTIVE MARKS AT A COMMUNITY IN HILLY REGION OF RIO DE JANEIRO STATE, BRAZIL
Abstract
The Ethnobotany is the study of human societies and their cultural and symbolic interactions with plants. GI is a type of protection that reflects the collective effort of defence and management of intellectual property rights that involves an explicit concept of collectivity. CMs are used to identify products or services originated by members of a particular institution. The GIs and the CMs can be used as strategic tools to differentiate and protect through intangible assets of intellectual property products generated by local communities in the market, thus adding cultural and environment value, offering the consumer a distinctive sign of their typicality. The ethnobotanical research was held in one rural community the hilly region of the state of Rio de Janeiro. Was suggested the possibility of protection of the geographical name "Rio Bonito of Fribrugo" as GI for the product as well as their taro production methods associated with it and CM protection for the Oficina das Ervas. These propositions help in the maintenance and creation of jobs as a possibility of sharing the economic benefits to the entire production chain, and also indirectly stimulate other profitable activities such as ecotourism. Thus, ethnobotany stands out as a research tool to indicate potential products and services that can be protected with GI or MC and represents another opportunity for a return to the community study.
