ANALYSIS OF CONTRACT BETWEEN THE STATE UNIVERSITY OF PONTA GROSSA AND PRIVATE COMPANY: THE LEGAL NATURE OF THE PUBLIC CONTRACTS OF TECHNOLOGICAL TRANSFER
Abstract
The hybridization of technology contracts is analyzed in terms of its legal nature, using a licensing
agreement signed between a public brazilian university and a private company. The last legislative
reforms of the matter sought to improve the relations between public universities and private entities of the Productive Sector. In this way, instruments are presented in the sense of a Public
Administration managed by contracts of private content, as well as a greater injection of public
characteristics in the private legal business. This essay seeks to demonstrate the parallel movement
of "publicity of the private" and "privatization of the public" in the current discussion of the state of
the public / private dichotomy in the globalized knowledge economy. In conclusion, the analysis
points that public contracts for technological innovation maintain the nature of administrative
contract of Public Law, possessing slight hybrid characteristics, seeking both the dynamism of the
private sector and the security of public interest in Public Administration.
